Below, we outline your key rights and how you can exercise them.

Right to Be Informed (GDPR Articles 13–14; CCPA §1798.100)

You have the right to receive clear, transparent information about how we collect, use, and share your personal data. This Privacy Policy provides detailed insights into our practices, including the types of data we process (e.g., email addresses, demographics, survey responses), the purposes (e.g., market research), and any third parties involved.

Right of Access (GDPR Article 15; CCPA §1798.100)

You may request a copy of the personal data we hold about you, such as profile information or survey responses. We will provide this data in a commonly used format, typically within one month under GDPR or 45 days under CCPA, free of charge unless the request is excessive. To exercise this right, please contact us at support@voqall.com.

Right to Rectification (GDPR Article 16)

If your personal data is inaccurate or incomplete, you can request corrections. For example, you may update your profile details or correct demographic information. We will address such requests promptly, generally within one month. Please submit rectification requests to support@voqall.com.

Right to Erasure (GDPR Article 17; CCPA §1798.105)

You have the right to request deletion of your personal data, such as when it is no longer needed for our research purposes or if you withdraw consent. We will erase your data unless we are legally required to retain it (e.g., for contractual obligations). GDPR requests are handled within one month, and CCPA requests within 45 days. To request erasure, email support@voqall.com.

Right to Restrict Processing (GDPR Article 18)

You may request that we limit the processing of your personal data, for instance, while we verify its accuracy or if the processing is unlawful but you prefer restriction over erasure. Rights Relating to Automated Decision-Making and Profiling

Voqall is committed to ensuring your rights are protected when we use automated processes, such as profiling, to deliver tailored survey opportunities. Below, we outline your rights under the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable data protection frameworks concerning automated decision-making and profiling.
GDPR: Right to Not Be Subject to Automated Decision-Making (Article 22)

Under GDPR, you have the right to not be subject to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects on you (e.g., decisions affecting your eligibility for services). At Voqall, we use automated tools to analyze profile data (e.g., demographics, preferences) to match you with relevant surveys, but these processes do not produce significant effects as they are designed to enhance your experience and are not fully automated without human oversight.

If you believe our profiling impacts you significantly, you may:

  • Request human intervention to review the decision.

  • Express your viewpoint on the process.

  • Challenge the outcome of the automated decision.

To exercise these rights, please contact us at support@voqall.com. We will respond within one month, ensuring transparency and, where necessary, involving human review to address your concerns.

CCPA: Rights Related to Profiling

While the CCPA does not explicitly provide a right to opt out of automated decision-making or profiling, you may exercise your right to opt out of the “sale” of personal data (§1798.120), which could include certain profiling activities if data is shared with third parties for monetary value. Voqall does not sell personal data; our profiling is limited to matching you with survey opportunities for market research purposes. However, if you wish to opt out of data sharing with research partners (which may involve profiling), you can submit a request to support@voqall.com, and we will exclude your data from such activities within 90 days of verification.

Additionally, under CCPA’s right to know (§1798.100), you may request details about how your data is used in our automated processes, including profiling categories (e.g., demographic analysis). Contact support@voqall.com for such requests, and we will respond within 45 days.

Other Global Frameworks

In jurisdictions like Brazil (LGPD, Article 20), you may have the right to request a review of decisions made by automated processing, including profiling, that affect your interests. Similarly, Japan’s APPI emphasizes transparency in automated data use. Voqall aligns with these laws by offering clear information about our profiling practices and ensuring you can request human intervention or opt out where applicable. For assistance, email support@voqall.com.

Our Commitment to Fair Processing

Our profiling is designed to enhance your Voqall experience by delivering relevant surveys, using secure, encrypted systems with strict access controls. We ensure transparency by explaining our processes in this policy and limit profiling to what’s necessary for research purposes. If you have concerns about automated decision-making or profiling, contact support@voqall.com, and we’ll address your request promptly. If unsatisfied, you may lodge a complaint with a supervisory authority, such as the Information Commissioner’s Office (GDPR) or the California Attorney General (CCPA).

How to Exercise Your Rights

To submit any request related to your data rights, please email support@voqall.com. We will verify your identity (e.g., via your registered email or survey ID) to ensure security and respond within the legally required timelines. If you are dissatisfied with our response, you may lodge a complaint with a supervisory authority (e.g., the Information Commissioner’s Office for GDPR or the California Attorney General for CCPA). Our commitment to transparency and robust security measures, including encryption and access controls, ensures your rights are protected while using Voqall’s services.

We process data both within and outside of the United States, and we rely on legal mechanisms to facilitate the lawful transfer of data across borders. To ensure that your personal data is appropriately safeguarded when transferred outside of your country, we adhere to the requirements specified in these mechanisms. We take data privacy seriously, and are committed to protecting your personal information to the best of our ability

The nature of Voqall’s services necessitates the flow of data from the European Union (EU) to customers, suppliers, and data processors within and outside the EU. To ensure that personal data from the EU is adequately protected when transferred outside of the EU, the GDPR mandates the use of specific legal mechanisms.

To comply with GDPR requirements, we typically utilize European Commission-approved Standard Contractual Clauses or equivalent measures to transfer data from the EU. These clauses establish contractual obligations between parties involved in the transfer of personal data (such as between Voqall and its customers, suppliers, or data processors located outside of the European Union). These obligations bind all parties to ensure the protection of data privacy and security throughout the transfer process.

At Voqall, we may share your personal and/or demographic information with third-party sample/market research firms (individually referred to as “Third Party MR” and collectively as “Third Party MR Companies”). This information may include a unique identification number (“UID”), zip code, gender, marital status, education, ethnicity/race (where permitted by applicable law), employment-related information, and non-personally identifiable information about family members.

If you are eligible for a customer survey opportunity provided by a third party, the third-party MR company will provide your unique identification number and survey link to us. We will then invite you to participate in the customer survey via email. Please note that we will not share your name, email address, or phone number with third-party MR companies.

It is important to understand that your information may be transferred and stored outside of your country of residence, including but not limited to, in the United States, when you provide your consent to our Privacy Policy. By consenting, you agree to the processing and export of your personal information.

If you have any questions regarding this data sharing, please contact support@voqall.com. You can also unsubscribe from these survey opportunities through your account on Voqall.com.

Voqall is responsible for managing all unsubscribe requests and is responsible to inform the third-party MR companies of any unsubscribe requests.

It is essential to note that your participation in these survey opportunities does not entitle you to any benefits offered by MR third-party companies or membership in them. We take your privacy very seriously, and any sharing of personal information with third-party MR companies will always be in accordance with applicable laws and regulations.

You may object to processing based on our legitimate interests, such as for service improvements. We will cease processing unless we demonstrate compelling grounds. You can also object to direct marketing at any time. To object, please email support@voqall.com.

Right to Opt Out of Sales (CCPA §1798.120)

Under CCPA, you can opt out of the sale of your personal data. Voqall does not sell personal data in the traditional sense, as we process it solely for market research purposes. However, if you interpret sharing with research partners as a “sale,” you may opt out, and we will exclude your data from such sharing. Submit opt-out requests to support@voqall.com, and we will comply within 90 days of verification.

Right to Non-Discrimination (CCPA §1798.125)

We will not discriminate against you for exercising your CCPA rights, such as by denying services or charging different prices. Your access to surveys and rewards remains unaffected.

Request human intervention to review the decision.

Express your viewpoint on the process.

Challenge the outcome of the automated decision.

Cross-border data transfer

We process data both within and outside of the United States, and we rely on legal mechanisms to facilitate the lawful transfer of data across borders. However, it’s important to note that the laws of the countries where we process data may differ from the laws in your country and may not provide the same level of protection.
